Language use is simpler than previously thought, study suggests

ScienceDaily (Sep. 25, 2012) ? For more than 50 years, language scientists have assumed that sentence structure is fundamentally hierarchical, made up of small parts in turn made of smaller parts, like Russian nesting dolls.

A new Cornell study suggests language use is simpler than they had thought.

Co-author Morten Christiansen, Cornell professor of psychology and co-director of the Cornell Cognitive Science Program, and his colleagues say that language is actually based on simpler sequential structures, like clusters of beads on a string.

"What we're suggesting is that the language system deals with words by grouping them into little clumps that are then associated with meaning," he said.

Sentences are made up of such word clumps, or "constructions," that are understood when arranged in a particular order. For example, the word sequence "bread and butter" might be represented as a construction, whereas the reverse sequence of words ("butter and bread") would likely not.

The sequence concept has simplicity on its side; language is naturally sequential, given the temporal cues that help us understand and be understood as we use language. Moreover, the hierarchy concept doesn't take into account the many other cues that help convey meaning, such as the setting and knowing what was said before and the speaker's intention.

The researchers drew on evidence in language-related fields from psycholinguistics to cognitive neuroscience. For example, research in evolutionary biology indicates that humans acquired language (and animals did not) because we have evolved abilities in a number of areas, such as being able to correctly guess others' intentions and learn a large number of sounds that we then relate to meaning to create words. In contrast, the hierarchy concept suggests humans have language thanks only to highly specialized "hardware" in the brain, which neuroscientists have yet to find.

Research in cognitive neuroscience shows that the same set of brain regions seem to be involved in both sequential learning and language, suggesting that language is processed sequentially. And several recent psycholinguistic studies have shown that how well adults and children perform on a sequence learning task strongly predicts how well they can process the deluge of words that come at us in rapid succession when we're listening to someone speak. "The better you are at dealing with sequences, the easier it is for you to comprehend language," Christiansen said.

The study by Christiansen and his colleagues has important implications for several language-related fields. From an evolutionary perspective, it could help close what has been seen as a large gap between the communications systems of humans and other nonhuman primates. "This research allows us a better understanding of our place in nature, in that we can tie our language ability, our communication abilities, more closely to what we can see in other species. It could have a big impact in terms of allowing us to think in more humble terms about the origin of language in humans," Christiansen said.

The research could also affect natural language processing, the area of computer science that deals with human language, by encouraging scholars to focus on sequential structure when trying to create humanlike speech and other types of language processing, Christiansen said. He pointed out that machines already successfully perform such tasks as translation and speech recognition thanks to algorithms based on sequential structures.

The study, "How hierarchical is language use?" was published Sept. 12 in the Proceedings of the Royal Society B: Biological Sciences. The research was funded by the European Union, the Netherlands Organization for Scientific Research and the Binational Science Foundation.

PFT: Dolphins RB Bush could miss few weeks

randy-moss-is-back-three-potential-landing-sp-L-JnqbGbGetty Images

For Randy Moss, when he?s getting plenty of balls thrown his way and the team is winning, everything is fine.? When that?s not the case, he eventually disengages.

In San Francisco, Moss isn?t getting many balls thrown his way because Moss isn?t on the field very much.? According to Matt Maiocco of CSNBayArea.com, Moss participated in only seven snaps during the second half of Sunday?s game.

He was in no mood to discuss the situation after the final gun, breaking out ?next question? for the second time in a week on the topic of his playing time.

Making it worse for Moss, who participated in 21 total snaps for the game, was that the game marked his return to the Metrodome, for the first time as a member of the opposing team.? Also, the 49ers lost the game, 24-13.

So if the Niners continue to lose and if Moss continues to be a non-factor, Moss eventually may do what he has done at least twice before in his career ? quit.

?I play when I want to play,? Moss once notoriously said.? For the first time in his career, he wants to play but he isn?t.? The ?next question? is whether he?ll get more reps going forward, and whether that will lead to more catches.

Jimmy Kimmel Opens The Emmys With Help From TV?s Leading Ladies, Jabs At Romney And GOP

video

Jimmy Kimmel hosted the Emmy Awards on Sunday night, but getting there wasn?t easy. As the show opened, we found a sobbing Kimmel in the lady?s room backstage, traumatized by a Botox job gone awry. Thankfully, a cast of some of television?s female actors ? from Zooey Deschanel and Mindy Kaling to Kathy Bates and Christina Hendricks ? were there to ?punch it back in? for Kimmel.

And the ever-reliable Ellen DeGeneres was there to lend him her pants.

Kimmel finally made it on stage, and kicked things off with a nod to the inventor of television, thanking him (?Nice job, dumbass?) for bringing us the likes of Here Comes Honey Boo Boo.

And then things got political. Noting that Downton Abbey ?is an amazing show,? Kimmel remarked that it ?gives you a sense of what it must have been like to grow up in Mitt Romney?s house.? Asking the crowd who they?re voting for, Kimmel observed, ?Being a Republican in Hollywood is like being a Chik-Fil-A sandwich on the snack table on Glee.?

Kimmel ended on a more self-depracating note, remarking that the night was an occasion to ?honor one thing we in Hollywood love more than anything else: ourselves.? After all, that?s how the Emmys were named. Emmy = M-E. Me.

Shaun White -- VODKA KING At Black Keys Wedding

Shaun White
VODKA KING
At Black Keys Wedding

EXCLUSIVE

0921-shaun-white-tmz
Shaun White
was VODKA MAN at the Black Keys wedding he attended before his public intoxication arrest last weekend -- sources tell TMZ, dude had his very own vodka handle at the party ... and was drinki-ng like a fish.

As we reported, a black-eyed White was arrested early Monday in Nashville following the wedding for Black Keys drummer Patrick Carney -- after allegedly trashing his hotel room, pulling a fire alarm, running from hotel staff ... and smashing his face.

Now, sources at the wedding tell TMZ, there's a good reason White was acting so crazy -- he had been on a vodka binge the entire night, carrying around his own personal vodka bottle, taking multiple shots with anyone game to join him.

One guest told us he saw White drink between 12-15 shots.

As we reported, White has since issued a mea culpa for the incident, saying, "I want to apologize for the unwise choices I made over the weekend and for any inconvenience it caused my family, friends, business partners, the hotel and their guests."

White says, "I was celebrating a happy occasion with a ton of family and friends and got carried away."

You can say that again.

Twitter CEO reveals plans for interactive tweets, content curation, reinforces belief in syndication

Twitter has ruffled a few feathers recently, so when CEO Dick Costolo took the stage at the Online News Association conference in San Francisco, he took the opportunity to put some minds at rest. First he dismissed the idea that the service would become a media company by forcing users to the site or official app for content, before reasserting his belief in syndication. Costolo then went on to imply that the reason behind the tighter (and unpopular) API controls was ensuring quality -- stating that Twitter would reach its full potential now there's more control over how tweets are delivered. With boots strapped, we can look forward to some new features, such as the option to curate messages that are published (such as during live events) plus tweets with interactive features like polls during live sports games. The famous 140 character limit is to remain, but will also serve as a "caption for additional functionality." Perhaps of most interest to disenfranchised developers, however, was the mention of application functionality in tweets, where short messages could contain small interactive apps. Something for devs to get potentially get back on board with? We hope so. But until further details unfold, we're still left considering our options.

How do we make moral judgments? Insights from Psychological Science

ScienceDaily (Sep. 21, 2012) ? We might like to think that our judgments are always well thought-out, but research suggests that our moral judgments are often based on intuition. Our emotions seem to drive our intuitions, giving us the gut feeling that something is 'right' or 'wrong.' In some cases, however, we seem to be able to override these initial reactions.

Matthew Feinberg and colleagues hypothesized that this might be the result of reappraisal, a process by which we dampen the intensity of our emotions by focusing on an intellectual description of why we are experiencing the emotion.

Across several studies, participants read stories describing moral dilemmas involving behaviors participants would probably find disgusting. Participants who reappraised the scenarios logically were less likely to make intuition-based moral judgments. These findings suggest that although our emotional reactions elicit moral intuitions, these emotions can also be regulated.

"In this way," the researchers write, "we are both slave and master, with the capacity to be controlled by, but also shape, our emotion-laden judgmental processes."

You See, the Ends Don't Justify the Means: Visual Imagery Influences Moral Judgment

In comics, superheroes are often forced by a villain to choose between saving a single person (usually their lover) or many innocent people. The villain expects the superhero either to make a deontological choice (it's wrong to sacrifice one for many) or a utilitarian choice (it's better to save more people). Most people (including superheroes) tend to use their imagination to visualize difficult scenarios.

To investigate what role visual imagery plays in moral judgment, researchers Elinor Amit and Joshua Greene tested whether volunteers were more visually or verbally oriented, then presented them with moral dilemmas. Visually oriented people were more likely to make deontological judgments, focusing on the one above the many. This is probably because they were more prone to visualize the harm being caused. So imagination can influence a person's moral judgment, though superheroes often use it to find a third option to thwart the villain.

American Airlines pilots union denies job action

(Reuters) - The union representing pilots at American Airlines on Thursday said it has called no job action at the bankrupt carrier, which this week canceled hundreds of flights citing increased pilot maintenance reports and sick leave usage.

American began implementing cost cuts for its pilots this month after a U.S. bankruptcy judge ruled the airline could abandon its collective bargaining agreement with the pilots union.

The airline, a unit of AMR Corp, said on Wednesday it canceled about 300 flights for this week out of nearly 24,000 departures planned across its network, including the American Eagle regional division.

American cited factors including "an increase in maintenance reports filed by pilots, as well as levels of sick leave usage that have been running higher than historical norms."

The Allied Pilots Association said in a statement that pilot sick rates and crew cancellations remain at normal rates, based on its tracking. The union said it had noted a rise in mechanical delays.

"There is no job action of any sort that is organized, supported or sanctioned by the Allied Pilots Association," the union's statement on Thursday.

The pilots are the only major work group at American that have not agreed on contract concessions since the airline filed for bankruptcy in November. The union voted down a final offer from the carrier in August.

From Monday through Wednesday of this week, American and American Eagle had canceled more than 250 flights, according to the FlightAware.com tracking service. FlightAware said cancellations at American have been well above the rest of the industry for the past two weeks.

American said it was reducing its flight schedule by as much as 2 percent through October.

Jets CB Darrelle Revis cleared for contact

FLORHAM PARK, N.J. (AP) ? Darrelle Revis is back in action for the New York Jets.

The All-Pro cornerback was cleared Thursday for contact in practice for the first time since suffering a concussion in the team's season opener.

Coach Rex Ryan was optimistic about Revis' chances of playing Sunday against the Dolphins in Miami, but is leaning on the team's doctors before saying the cornerback will definitely be on the field.

"If it's not the final hurdle, I don't want to be saying something that isn't true," Ryan said. "Hopefully he'll play, but I guess we'll see."

Revis was expected to practice fully Thursday after passing all required tests. He needed to be cleared by the team physician and an independent neurologist to participate in contact drills. Revis was injured Sept. 9 against Buffalo when he was accidentally kicked in the head by teammate Bart Scott while attempting a tackle.

He'll be re-evaluated after practice Thursday and Friday, but barring a setback, Revis will be back in the Jets' secondary on Sunday.

"I think you feel good when you have the best player on the field," Ryan said. "That can't hurt you. ... There's only one Darrelle Revis. I know I feel great about it. It's hard not to smile. You feel great as a playcaller."

Revis didn't travel with the Steelers for the game in Pittsburgh after not being cleared for contact late last week. He said he felt as though he were in "a fog" right after he was injured, but progressively felt better.

Tight end Dustin Keller (right hamstring) and safety Eric Smith (hip/knee) were upgraded Thursday to limited after not practicing Wednesday.

Markets unmoved by Bank of Japan easing

LONDON (AP) ? Japan's main stock market hit a four-month high Wednesday after the country's central bank eased monetary policy to shore up fragile economic growth, but the positive momentum ground to a halt in Europe.

The Bank of Japan said it was increasing its asset purchasing fund to 55 trillion yen ($700 billion) from 45 trillion yen to counter the strength of the Japanese currency. A strong yen makes it more difficult for Japanese companies to compete in international markets.

The Bank of Japan's move comes days after the U.S. Federal Reserve revealed it will purchase an average of $40 billion a month in mortgage-backed securities until the economy shows significant improvement. The Fed's goal is to lower long-term interest rates and encourage more borrowing and spending. The Fed also said it plans to keep its benchmark short-term interest rate near zero until mid-2015.

Stock markets, which tend to respond favorably to actions targeting economic growth, rallied sharply following the Fed's announcement. However, outside of Asia, where Japan's Nikkei 225 stock index rose 1.2 percent to 9,232.21, its highest close in more than four months, the response to the BoJ move has been far more modest.

"Perhaps we are seeing investors suffering from a bout of central bank fatigue, or perhaps it is a dawning realization that, even with policymakers dispensing cash left, right and center, there is still a slowing global economy to deal with," said Chris Beauchamp, market analyst at IG Index.

In Europe, the FTSE 100 index of leading British shares was flat at 5,871 while Germany's DAX was down 0.1 percent at 7,342. The CAC-40 in France was also 0.1 percent lower at 3,508.

Wall Street was poised for a flat opening too, with Dow futures and the broader S&P 500 futures up a modest 0.2 percent.

The main piece of economic data out of the U.S. later will likely center on the housing market with new starts and existing home sales figures due.

Adam Cole, an analyst at RBC Capital Markets, said the figures are "likely to continue the picture of very moderate trend improvement."

Earlier in Asia, stocks were generally fairly buoyant after the Bank of Japan's easing announcement.

Hong Kong's Hang Seng climbed 1.2 percent to 20,841.91 and Australia's S&P/ASX 200 added 0.5 percent to 4,418.40. South Korea's Kospi gained 0.2 percent to 2,007.88. The Shanghai Composite Index rose for the sixth straight trading day, up 0.4 percent to 2,067.83. The Shenzhen Composite Index gained 0.7 percent to 865.73.

In the currency markets, the Bank of Japan's announcement had little impact. The dollar was up only around 0.1 percent on the day at 78.93 yen. Meanwhile, the euro was more or less flat around $1.30. The euro has enjoyed a stellar few weeks as concerns over Europe's debt crisis have eased somewhat, largely on the back of a new bond-buying plan from the European Central Bank.

In the oil markets the benchmark New York rate was down 37 cents at $94.92 per barrel in electronic trading on the New York Mercantile Exchange.

2 hrs.

On Wednesday, LG held a press event in New York City to show off its new Optimus G smartphone. We had a chance to give the device a quick trial run?? and we were pleasantly surprised.

The Optimus G?uses a quad-core Snapdragon S4 processor. In plain terms, this means that it's zippy, despite running a heavily skinned version of Android. During the time I spent with the device, I noticed no obvious lag or any pesky hiccups.

I certainly did expect quirky or slow behavior from the device as it has a multi-tasking ??or "cross-tasking," as LG calls it?? ?functionality.?

You can run two apps simultaneously, with both shown on the display. This means that you can send a text message or look up something on the Internet while watching a video. You can also?take notes over any screen and fade your scribbles in and out with an opacity slider. (This is actually rather useful if you jot down a phone number and then dial it ??no need to switch between apps.) These cross-tasking features work surprisingly well?? especially when compared to the features we'd seen with the?Samsung Galaxy Note 10.1?? but unfortunately they are still a bit limited. You can use any app together with the video player and you can use any app together with the note-taking functionality. But you can't use any random two apps at the same time.

The Optimus G has a 13MP camera which gets plenty of support from features which adjust for movement, correct shutter speed, take multiple shots or allow voice commands to trigger the shutter (you can?literally just say "cheese" to snap a photo).

The 4.7-inch screen on this smartphone is pleasantly bright and vibrant. Indoors, it looked fantastic. I do wonder how it performs in bright sunlight though.

All in all, the Optimus G seems like a great device. It's speedy, looks good, feels good (and light!), and doesn't have any instantly obvious annoyances. I can't wait to try it out for more than a few minutes and see if those first impressions ? and the device's battery, for that matter???last.

No word on shipping or pricing details just yet, though word is that the LG Optimus G will hit shelves before the end of this year.

Syrian rebel leader wants Libyan-style Arab initiative

DUBAI (Reuters) - Syria's main opposition bloc wants Arab states to work together to effect an international intervention in Syria similar to the joint initiative in Libya, Syrian National Council (SNC) head Abdulbaset Sieda said in an interview published on Wednesday.

"We call on the Arabs to undertake a clear and serious initiative, like the position they took towards the Libyan revolution," he said after talks in Doha with Qatari officials.

The Arab League asked the U.N. Security Council for a no-fly zone last year to protect civilians in Libya, paving the way for NATO and Arab allies to help rebels overthrow Muammar Gaddafi.

Sieda also told pan-Arab al-Hayat newspaper, that the SNC objected to Iran's participation in efforts to resolve the Syrian crisis, saying Tehran was part of the problem.

The West has shown little appetite for repeating any Libya-style action in Syria, and Russia and China, both veto-wielding powers on the U.N. Security Council, oppose such intervention.

Syrian President Bashar al-Assad has been battling an uprising which began as peaceful street protests last March and escalated into a civil war in which over 27,000 people have died. Daily death tolls are about 200 and last month was the bloodiest yet.

Sieda, speaking after talks with Qatari Prime Minister and Foreign Minister Sheikh Hamad bin Jassim bin Jaber Al-Thani, who heads an Arab League committee on Syria, said everything should be done to stop the killings in Syria.

"There must be a serious initiative to move with the Europeans for the purpose of removing complete legitimacy from the regime first and not to let the killing of Syrians to continue in this manner. Thus, there must be pressure," he said.

"We demand everything that will stop the killing of Syrians, there is Chapter Seven at the Security Council, which puts all options on the table, including international intervention to stop the killing," he said, referring the option of using military force against Assad's forces.

Sieda also dismissed the chances that Egyptian President Mohamed Mursi's initative for a "contact group" to try to resolve the Syrian crisis would succeed, saying he opposed Iran's participation in the efforts.

"We believe that Iran is part of the problem," Sieda said.

"Iran is providing the regime with arms, money and plans, and even the commander of the Revolutionary Guards admitted that there are men from the Revolutionary Guards inside Syria."

Former international mediator Kofi Annan had wanted Iran to be involved in efforts to find a solution to the Syrian crisis. He resigned in August complaining about a diplomatic deadlock at the U.N. Security Council.

Sieda said the first sign of failure were evident from Saudi Arabia's boycotting of the meeting of Mursi's contact group. Saudi Arabia stayed away from the meeting held in Cairo on Monday, a setback for the forum, which includes Turkey and Iran.

"We have informed Egyptian President Mohamed Mursi's aides of our reservations over the Iranian participation," he said.

The SNC has been torn by a power struggle between Islamists, secular politicians, exiled leaders and activists in Syria, undermining its claim to be an alternative to Assad.

Difficult Relationships ? The Managers Hub

Nothing new here: managing involves handling some difficult relationships. Communicating effectively and balancing between reaching the other person and staying in your power is key. Often, difficult relationships have less to do with the content of a situation and more to do with personalities and emotions. Your communication strategy then, must reflect this.

Identify now a difficult relationship you have at work. What is your communication strategy with this person? It would behoove you to look beyond the work related aspects of the relationship (their position in the organization relative to yours, their responsibilities in your organization) to personal and emotional aspects of the relationship (the emotions they show at work that make the relationship difficult, the emotions you have about them, how you react to your interactions with them, the differences and similarities of your personalities). Get a fuller picture of what you are dealing with.

Once you have that picture, let your communication strategy reflect it, at the same time maintaining your own integrity and power in the relationship.

DAILY TRANSFORMATIONAL NUGGETS FOR THE BODY, MIND ...

DAILY TRANSFORMATIONAL NUGGETS FOR THE BODY, MIND, AND SPIRIT: ?Remember? Day 17 ? ?The Bridge?

Today?s Body Connection:? Our physical practice helps to bridge the gap between our desires and our greatness.? When we set the intention for a life that is fulfilling, full of health and fitness, it is the action that brings the vision to life.? When we participate in our workouts, it connects us to a space of infinite possibilities.? Completing a vigorous training session or a long run reveals our greatest ability and potential to achieve anything and everything that we can conceive.?? Remember, the moments when you climbed to the top of a hill on a hike, or finished a bike ride, or when your trainer said, ?well done,? at the conclusion of a workout, your energy is so high and the vibration is out of this world.? We must ride that inspirational wave; it helps us to pursue our dreams.? Apply that powerful feeling to everything you do.? Watch your life expand beyond your current paradigm.

Today?s Meditative Thought:? Remember, spiritual growth can only be achieved with a willingness to surrender to the practice.? Meditation, prayer, affirmations, sacred study, fellowship, and generosity are the bridges to transformation.? When we say yes to our own spiritual and physical growth, there must also be an action for the fulfillment of the intention.

Today?s Action Plan: ?Today, remember that what bridges our consciousness with God is the ability to connect with God.? During your time in meditation, cultivate your connection to your higher self.? Do not move until you know that you know.

Today?s Affirmation:? Just for this moment?just for this breath, my practice expands my life, and there is nothing I can?t do.? I stand in the knowing that I am one in God.? Amen

Light-Sensing Chip Captures Elusive Sperm Swimming Pattern

A lens-free system has provided the first direct evidence of the spiraling swimming pattern of sperm

Sperm A scanning electron micrograph of sperm on Earth. Sperm movements are notoriously hard to catch on camera. Image: http://weboflife.nasa.gov/images/sem_sperm_med.jpg

By Helen Shen of Nature magazine

Human sperm have been caught twirling in an elaborate dance. A new three-dimensional imaging technique has revealed spiraling movements that had previously only been inferred from two-dimensional data.

The study, published today in the Proceedings of the National Academy of Sciences, describes the first large-scale, high-resolution recordings of human sperm in three dimensions, tracking more than 1,500 cells over several hours. Human sperm have eluded such detailed observation in the past. Their heads are just 3?4 micrometers long and can only be seen under high magnification, but the cells zoom around at up to 100 micrometers per second, ducking in and out of focus or darting out of range in an instant.

?Our intention was to create something not bounded by conventional optics,? says Aydogan Ozcan, a bioengineer at the University of California, Los Angeles, who led the study. ?This is the first observation of something that was entirely hidden.?

The research team watched the wily sperm not with a conventional microscope lens, but with a light-sensing chip ? measuring about 4 by 6 millimeters ? placed underneath the translucent samples. A red light-emitting diode (LED) shines down on the sperm, forming a hazy shadow on the chip that follows the head of each cell as it moves horizontally. A second, blue LED illuminates the sperm from a different angle, casting shadows that change with each sperm head?s vertical position. Imaging cells en masse at about 90 frames per second allowed the researchers to characterize sperm movement more precisely than ever before.

More than 90% of the sperm moved along slightly curved paths, wiggling their heads slightly from side to side. A small fraction ? 4?5% ? traveled in near-perfect spirals, forming helices between 0.5 and 3 micrometers in radius (see video, below). Most of the helices were right-handed, but Ozcan says that it is too early to know whether this preference serves any physiological function.

Susan Suarez, a sperm researcher at Cornell University in Ithaca, New York, is curious about the significance of the swimming patterns. She hopes that the method can be used to study sperm swimming under a wider range of physiological conditions, including the pH and fluid conditions encountered by the sperm en route to an egg.

Chip-based imaging could one day lead to cheaper and more portable ways for fertility researchers to look at sperm movement, replacing costly computer systems that analyze microscope images. But Ozcan says that his technique ? which can be used only on translucent materials ? could also be used to study bacteria and other swimming microorganisms.

Illuminating possibilities
David Brady, head of the Duke Imaging and Spectroscopy Program at Duke University in Durham, North Carolina, says that the sperm imaging is ?a great demonstration of an application? in the growing field of lens-free imaging. Smaller and more powerful technologies have emerged in the past 5?10 years, he says, that have yet to cross over into mainstream experimental biology. The authors have come up with an application that will ?get people talking?.

Some sperm biologists think that the technique could also open up research avenues. ?I?ve been trying to find a way to look at sperm ? moving sperm ? and this seems like it would be a good method,? says David Clapham of Boston Children's Hospital in Massachusetts. ?The beauty of this is that it?s done so quickly and on so many cells at once.? However, Clapham says, the method tracks only sperm heads, so can't capture the complex tail movements that are crucial to understanding sperm function ? and dysfunction.

The skinny tails, which can measure less than half a micrometer across, would require improvements to the imaging technology, says Ozcan. But, he says, ?it?s definitely possible?.

Calif. DNA collection from arrestees challenged

(AP) ? An Alabama man was charged this month with the 1980 murder of an Oxnard teen. A Placerville man was arrested last month for a 1986 rape and murder of a San Mateo teen. A San Francisco man is currently on trial for the murder and robbery of a tourist two decades ago.

Technological advances in genetic research and computers in recent years have turned solving "cold cases" into near-routine police work. The California Attorney General reports that the state's DNA database of close to 2 million samples spits outs more than 425 "hits" a month, more than double the average monthly rate of 183 in 2008. More than 10,000 suspects have been identified in the last five years.

But on Wednesday, the American Civil Liberties Union will argue before a federal appellate court in San Francisco that California's DNA collection efforts have become unconstitutionally aggressive and that the spike in hits comes at the expense of civil liberties.

The ACLU is asking the 9th U.S. Circuit Court of Appeals to strike down California's Proposition 69, which authorized police to obtain a genetic sample from every person arrested on felony charges, not just those convicted. Some 25 other states have enacted similar laws since 62 percent of the California electorate passed the measure in 2004.

The issue of the warrantless swabbing of the cheek with a Q-tip of everyone arrested for a felony has sparked one of the hottest "search and seizure" debates in state and federal courts in decades.

The U.S. Supreme Court has already signaled its willingness to review Maryland's DNA collection law after a federal appeals court there ruled it unconstitutional in April. The California Supreme Court has agreed to review a lower court's overturning of the California law. Several other state and federal courts have already ruled or are weighing the issue throughout the country.

While the courts are sorting out the issue, California law enforcement officials are collecting more than 11,000 samples a month.

"Cold hit DNA is integral to bringing criminals to justice," said San Francisco District Attorney George Gascon, whose office is prosecuting William Payne for the 1983 strangulation murder of Nikolaus Crumbley. Crumbley's body was found in the city's McLaren Park along with DNA that was finally matched to Payne earlier this year. Payne denies killing Crumbley, saying his DNA was found at the scene because the two had had consensual sex. The match was made after Payne submitted a DNA sample after an unrelated assault conviction.

"Almost three decades later, we have charged the person responsible for this horrific murder," Gascon said.

The 9th Circuit itself has previously upheld the California law, which went into full effect in 2009. But underscoring the importance of the debate, a majority of the court's 24 judges voted to reconsider that divided ruling of three-judge panel. The matter now goes before a special "en banc" court of 11 judges.

Judge Milan Smith Jr., in writing the majority opinion of the three-judge panel, likened the expanded DNA collection efforts to nothing more than the 21st Century's answer to fingerprints.

Since 1998, California has collected DNA from convicted felons to help solve crimes. In addition to solving cold cases, the technology has also led to the exoneration of at least 200 wrongly convicted nationwide.

But California's proposition expanded DNA collection to those arrested for felonies ? an important distinction to the ACLU and privacy advocates. They argue the cheek swab of the arrestee comes too early in the criminal justice process, because not every felony arrest leads to a felony conviction, and every American is innocent until proven guilty. The critics aren't challenging the state's right to collect samples from those convicted of felonies.

"Testing those who are actually convicted serves the state's legitimate interests in obtaining samples from proven criminals while avoiding the threats to privacy created by testing everyone arrested, including those who are innocent," the ACLU's Michael Risher argued to the court.

The ACLU is representing three Californians who say they are among the 50,000 people arrested for felonies every year in California but never convicted of a felony. They say their privacy was invaded by the cheek swabbing during their arrest and incarceration, usually during booking.

Lily Haskell, one of the plaintiffs, gave a cheek swab after she was arrested at an anti-war rally in San Francisco three years ago and charged with a felony. The felony charges related to the protest were quickly dropped.

"Now my genetic information is stored indefinitely in a government database, simply because I was exercising my right to speak out," Haskell said.

Completing Style Recipes With Designer Protective Eyewear

Whenever style icons are interviewed about their "style recipe", they typically enumerate the most versatile pieces in their fashion arsenal. From their favourite pair of jeans that they can wear to dressed-up or -down occasions, to the accessories that do not only uphold their personal brand of style but also perform a particular purpose. One of the really functional accessories that they incorporate to their style is that reliable pair of designer sunglasses.

Sunglasses are not only super fashionable, but they are accessories highly recommended by health experts. Because of the depleted ozone layer, it's very important to protect the eyes from the intensely damaging effects of UVA and UVB rays. Even corrective glasses that make use of prescription lenses (such as reading, single-vision, multi-focal and progressive lenses called varifocals) need to have protective coating or treatment against these ultraviolet rays and blue light.

The oversized sunglasses which have been in trend since the late nineties are even expected to become the standard size for protective eyewear because not only do they protect the eyes but also the skin surrounding the eyes which is prone to moisture dehydration that lead to spots and deep wrinkles. Opticians also claim that the big-sized frames and lenses provide better shield from a lot of particulates carried by the wind that irritate the eyes.

Fashion-wise, designer sunglasses create versatility for any get-up. They can come in standard black which remains to be the most fashionable colour, or other hues that flatter features, such as complexion, facial shape and even hair highlights. If a person's wearing all-black outfit, a pair of black sunglasses provides style continuity, if the sunglasses are of a different colour or have prints; they automatically add a fun contrast to the get up.

According to fashionistas, intricately designed shades, have the ability to completely elevate one's style. They can draw attention and light to the face, or conceal facial imperfections like dark under-eye circles and messy eyebrows, or really just glam up the face by complimenting the make-up or the hairstyle of the wearer or hair accessory.

Judging by the images available online, celebrities solidify their star status by wearing designer glasses; whenever they're out and about, they maintain their celebrity appeal when they're wearing these special shades more than when they're not. Perhaps doing so easily displays their trendiness, as well as their enviable ability to purchase the most expensive eyewear brands in the market. Overall however, sunglasses are just stylish and no fashionable person's style formula will be complete without them.
